I can see no legitimate reason why a teacher would refuse to keep extra materials on hand in the classroom.
If your son has an IEP or a 504 Plan, write this in as an accommodation. If your son doesn't have a formal plan, and if the teacher won't be reasoned with, try tying a pen or pencil to a string, and either clipping this to your son's pants pocket or to a clipboard in his backpack.
