Denial after denial for 504

We have approached the school board 3 times now and everytime have been denied a 504 for my child. The psychologist and primary care physician have written letters stating that my child would benefit from a 504. Diagnosis of ADD, OCD, Panic disorders, Anxiety and depression have plagued my child for a long time. Until last year my child was getting all A's in advanced classes and scored in the 98th percentile in math, 95th in english and 96th in the communication arts and scored a 34 on the ACT as a high school sophomore. My child takes all available advanced classes just so as not to get board and lose track of what is going on. Now the report card is showing D's and F's it has all finally caught up and created a severe impact. The teachers, administrators and Special Education departments all say there isn't a problem and that she doesn't qualify for a 504 because the condition doesn't "affect one of lifes major activities" as stated in the law governing 504. I've spoke with Office of Civil Rights and they say that it sounds wrong (a complaint has been filed). I've spoken with my state Department of Education 504 compliance director and they say it's wrong but alas nothing is done to help us. At this point any contact with the schol district is becoming advisarial and is having even greater affect on my childs education. Any recommendations or advice is welcome. Thanks

Get an advocate

You may even qualify for an IEP Plan. The question is whether or not your son just needs accomodations or needs services. Accommodations would be things like preferential seating, longer to take test, etc... Services could be organizational skills, behavior plans, specalized instruction.

I suggest you get an advocate to help you. I see cases all the time where the schools are not correct in its determination.
