School Negligence Continues ....

We are still having problems with my son's school. This is his third week of summer school (only one more week to go). Yesterday he got in trouble. He forgot to take his medication. I was very sick with the stomach flu and was not able to help him get ready for school.

Got a call from one of the many summer school principals (they keep changing every few days). She told me that any more trouble from my son and they will expel him from summer school (they have a no tolerance policy).

I asked the principal to try implementing some of the strategies and accommodations to help my son. She asked me what I wanted to do! I told her to just do what my son's 504 Plan says, and what teachers usually do to help the kids. She was not even aware that my son has a 504 Plan!

I told her that I have contacted all of my son's teachers (including his three summer school teachers) several principals and several administrators, and reminded them that my son has a 504 Plan. I had a good talk with one of my son's summer school teachers (1st period). His 2nd period teacher contacted me the second week. They both acknowledged that my son has a 504 Plan and they will implement the strategies and accommodations to help my son. Still have not heard back from the 3rd period summer school teacher ....

Even though I communicate with the teachers and other staff about my son's serious medical problems (ADHD, hypoglycemia, serious emotional trauma, and other medical issues), it seems as if the teachers basically just do whatever they want, like ignore my son's special needs, and ignore my son's 504 Plans, and ignore their duty as a public school teacher to help my son!

I filed another complaint with the California Department of Education. Today I am expecting a call from the Learning Director (another one of the summer school principals). I really believe that this school district is negligent, and not taking my son's condition seriously.

One of my son's summer school teachers would not allow him to use the bathroom. She has a very long list, and my son was on the bottom of the list. My son told the teacher that his 504 Plan allows him to use the bathroom when he needs to, but she insisted that he must wait!

Supervision at this school seems to be very shoddy, and not fair. My son is frequently harassed by other students. When my son reports the problems, he gets into trouble.

There is also a serious lack of communication between the various staff members. This is all very frustrating ....

District Office

Have you spoken to anyone in the District Office? I understand your frustration with the situation, but I can tell you that CDE complaints are great at making staff's lives miserable... However, I have never seen a compliance complaint really help the kid... just punish the staff.

Step #1 - Keep a good notebook on everything that you have and be organized. Step #2 - Get the name of the district 504 or Special Education Director/Coordinator. (private message me the district, I can find that out... I may even have a personal contact though www.casponline.org). Step #3 Write a very concise letter of your complaint, the rule that you feel is being broken, and a specific remedy.

Mail it priority with a confirmation delivery or Fax and keep the delivery confirmation.

Wait a few days and follow-up with a phone call.

You should be able to get a positive response in 1-2 weeks in what it would take a CDE complaint 1-2 months to do poorly.

Again, if it fails, you have the power to say, "I tried to play nice." in your next complaint.

I'm already working on organizing several binders and folders, with my own personal notes and articles ..... Yes, I have contacted several people from the District Office.

I have the names of everyone I might need to contact. Actually I've already contacted all of them.

I did send a letter in the regular mail (about six weeks ago) for my first complaint I sent to CDE. Have not yet received a response ....

Yesterday I did receive a phone call from the CDE (regarding my second complaint). They gave me a phone number for the Special Education Department that handles issues related to 504 Plans and IEPs.

Hi there! I have an MA in Special Ed. and have been doing advocacy for 20+ years. I am sorry to hear you are having such a hard time with your school. First of all, a child with ADHD qualifies for an Other Health Impaired (OHI) label, and not a 504 plan. A 504 plan has no accountability built into it, and leaves you with no recourse if you with to have a mediation hearnig. I would contact your State Dept. of Education. In CT. we are able to print complaint forms right off the State Dept.'s web page. When you do this, a hearing officer will automatically be in touch with both you, and your school. Half of my businees is getting parents off of a 504 plan, and labelled under the Individuals with Disabilities Education Act. I have been into many High Schools where the teachers did not even know the child had a 504 plan! Why? There is no accountability. It is a civil rights act, that was designed to prevent discriminatation, for children who do not meet the qualifications, under IDEA! Best Wishes!
