Workplace harrassment

My 23 yr., college graduate daughter, is being verbally harassed and imtimidated by her female boss. The harrasment started when my daughter call her boss on a 2 hr. short check since that time she has called her stupid, dumb,etc. Her one year anniversary is coming up which means she will be getting benefits (only 2 other people have made it to 2yrs. of employment at this daycare)and it appears that the boss does not want to have to give her her benefits. She is one of the only employees that is on time and is never out ill( you are not allowed to be ill or take time off or you will be the target of the boss). After a major inspection in Dec. the boss admitted that one of the reasons that they passed was because of my daughter's care and attitude. She also is one of the only employees that work a 40 hr.+ week. My feelings are if she was such a horrible employee why is she getting so much time? If this abuse(which is making my daughter ill)continues do we have recourse under The American's With Disabilities Act? I have worked 39 years and have never met such an evil(the only way I can describe her)boss. Any suggestions would be appreciated.

Based on what you present, it is hard to answer. Everything that I see so far is that the boss is an... well a synonym for the anal sphincter. Although not cool, being an a--hole is not illegal unless it leads to an illegal act.

I don't see an ADA complaint unless there is evidence that she is singled out for a disability.

There may be some labor issues with the denial of benefits. Is there a chain-of-command, or is the boss the top dog? Is this Day Care privately or publicly funded? Is it a a single proprietorship, franchise, or corporately owned? Those questions may suggest the best course of action. Legal action is one, but so is finding another job - an internal complaint - a license complaint - etc.

They all start with good documentation and evidence.

However, she needs to carefully consider unintended consequences.
