Is this a case fo a Disability Lawyer?

My children attend a Baltimore City Charter school and I am being charged with 2 counts of Truancy. I have a 10 yr old who has adhd/odd and anxiety disorder. I also have a 6yr old who has no known disability. My son has 504 plan and I requested an IEP meeting. The problem is that procedures were not followed for my son or daughter to address the issue before the referral had been made. I have reviewed there attendance reccords which arent accurate, for various reasons and I have physically been present in the school for at least 50 school days this year. I believe that this is partial retaliation for complaints that I placed to the school board, and the other because I associate with 2parents that he has disputes with over there special needs children. I am a Mom who is ADHD-and suffers from occassional depression, and now I have just developed a Thyroid problem. Most of my sons absences should be exscused because they are Dr. appt., the others are medication related a few would be for issues related to his anxiety, the others are simply incorrect. My daughter however does have a few unexscused absences because she would have had to go with me for her brothers appt. Unfourtunatly there are times where she was a casualty. The school was very aware of everything. There is more that could be said but it would only be different variations of the same. I need someone who can handle both charges, they will need to be empathetic. I have been unable to formulate a complete thought for weeks, and it has been impossible to explain to someone who isnt familiar with what its like to feel inadequate. I have never needed some one to defend me or my children but I believe that this is bigger than me.

There are two sides of the legal issues...

Truancy ticket - In CA, based on the facts that you present, the ticket would stick. Unless you had documentation for every absence, the few unexcused absences in the face of the others would be enough for a 1st time offense to stick, but you would probably be spared from the very costly "habitual truant". As a former supervisor of a truancy officer, once the ticket is written only the court can determine the outcome. However, I am neither a lawyer, nor do I know the rules in your state.

504 issues - That is too complicated to answer online. It would not hurt to consult with someone local and knowledgeable.
