won't test son till he is failing

I suspect other learning disorders (the school board does acknowledge that ADHD is a learning disability) but the school won't test my ten year old son until he is failing for two semesters. He has to not being able to complete work at grade level. This is very frustrating!

ask for a student success team meeting first

I would first ask the teacher or principal for a Student Success Team meeting, which should include you, his teacher, a school administrator, the school psychologist and the school Resource or Education specialist. At that meeting you can discuss your concerns and hear the specific interventions the school is providing to your son. If you still want testing sooner than later, you can then write a letter specifically asking for an assessment to determine his eligbility for special education services and submit it to the principal of his school. The school will then have 10 days to respond with an assessment plan for your approval. Once you sign that and return it to the school, they have 60 days to do psycho-educational and academic performance testing, prepare reports, submit them to you and have an IEP meeting (with the same people at the SST meeting) to determine his eligibility.

I'm not sure how that would work in Canada. I have had a team meeting, but they said the school psychologist cannot get involved until he is failing.

You should submit this under the legal expert's forum. It's a very good question, but one that would be hard for anyone from the US to answer (and probably a good portion of Canada, for that matter).

I am sorry to hear about your situation -- that is ridiculous that they require failure in order to intervene -- I think your son's school should get an F for that!
