IEP in Place but Teachers Not Following! Help!

After lots of prayers and a good fight, I was successful in getting my child an IEP under the OHI category. The problem is that the teacher still do not wont to follow it. The year is just beginning and my daughter has 3 zeroes in one class for forgetting to turn in work. She completed the tasks at home but failed to turn them in. Although I spoke with school teachers at beginning of school year and requested emails when an assignment isn't returned, no one emailed. Naturally, I assumed she was getting the hang of things until her progress report came home with a 56 average. When I try to talk calmly to teachers about my daughters issues and my concerns, they always use the excuse: "I have over 150 students they are responsible for and don't have time to reinforce everything with her or spend extra time explaining ". I explain the accommodations under her IEP such as co teaching, extra time on assignments, reminders, oral read instructions, etc but it comes back that my daughter still need to be responsible for herself. I am told there are not enough teachers for co teaching in each class bc of school budget. I don't want to make things hard for me daughter bc of some pissed teacher is mad he/she has to DO their job but more importantly I don't want my baby to suffer when I know she has a problem.... So I guess my question is how to make sure IEP is being followed. Please, any advice?!

Enforcing an IEP

Once an IEP is signed it is a legal document and MUST be followed. If it is not you have the opportunity to find a school (even private school!) that will follow your IEP and your public school system is responsible for paying the tuition. If it is $5,000 or $35,000 it will be the school system's responsibiliy if you can show that they are not following the plan. I currently have three friends who have the school system paying for their childs privated education b/c they did not follow the IEP. If you have talked to the teacher about this, the next step is to send an email to the principal and person that is HEAD of the Special Ed. Dept for you district. Things should change VERY fast once this email is sent. Due to budget cuts they do not want to pay a private school tuition. It will be cheaper for them to higher an aid for your daughter then to do this. If you find they are still not following the IEP, Google "IDEA". This is the disability law that protects our children from what is happening to you. It is lengthy, but you should read ALL of this so that you understand what your rights are. This may not be the last time that you deal with situation. High school is even worse. Educate yourself as much as you can and document EVERYTHING. Keep every email you send and get back from the school system. NEVER request anything verbally. It should always be in writing. Best of luck to you. Remember to never give up! Let the school district know that you are going to file an Office of Administrative Hearing and they will start jumping through hoops to please you and to make sure that the school is filing the IEP, and then really file one. You can google "Office of Administrative Hearing" and it will take you to the website. For every infraction they are violating on her IEP (not providing the service) it is a $10,000 fine that the school district is responsible for paying to the parents (I believe). Good luck in your fight. We finally after 7 years just got an IEP for our daughter as well, and she starts Junior High next year. We are having the same issues and are getting prepared to file our own Office of Administrative Hearing.
