Need Advice When it Comes to School and Teachers

Can a teacher suggest that my son only go to school a half a day and be sent home with the rest of his school work, because she can't handle him without his medicine (he's off due to medical reasons until cleared by cardiologist). I just recently found out the school wasn't keeping up or helping knowing he had a 504, he wasn't getting pulled for his tutoring, in short the school was not following the plan they set for him. What should I do? What are my rights? I feel really offended his teacher suggested what she did.

1. Meet with the school and find out why they have not been sticking to the 504. 2. Download a copy of the NCLB laws. You want sections §§300.000 to §§300.end specifically. 3. If teachers/educators/administration refuse to work with you on a 504, push for an IEP. Also, if your child is being sent home because of ‘behavior’ issues in class (apparently why the teacher is unable to handle him for whole day), ask for a Functional Behavior Assessment (FBA). This is something that tells you what the behavior @ school is, how the school (note I say ‘school’) is going to help handle this in/during the school day. This is usually done by a counselor (psychological, or guidance, social worker, someone). You need to find out what the behaviors are that the teacher is unable to handle. If you do not see an FBA before or during any IEP meeting, if you can leave, politely let the committee/school psychologist know that you will be glad to meet with them when they have completed all the necessary paperwork. The FBA is VERY important when a teacher has determined your child has behavior issues. I know. Once I got an FBA requested/done, they gave my son an IEP. He had a 504 since kindergarten and I couldn't get an IEP for my (or his) life before I had an advocate. 4. Ask for a psychology re-evaluation at the school and an IEP committee meeting. Even if you don’t get what you want in the meeting, sounds like your child needs to be on an IEP to get the school teacher/administrators to do what they need to do to help your child. 5. See if you can find an advocate at your local Learning Disabled office or maybe a local CHADD or ADD organization in your area.

Be careful of any school offered advocate. Remember, they work for the school district/IEP committee. They can give information/advise, but you want to make sure you have someone (if possible) on your side (at least to give you suggestions, feedback, anything). Section 504 only need to be followed—if teachers/administrators WANT to follow it—IEPs are mandated by federal and state laws that teachers/administration must follow the accommodations/modifications. How very frustrating. Federal law requires the school to provide special education services. However, it sounds like you are going to have to put in some time advocating for your son.

I feel your pain!

This sounds very similar to what we have been going through. The teacher was getting into the "habit" of sending my son to the office every day at 8:15 or 8:30. Then the assistant pricipal would call me to come get him because they "didn't have time" to sit with him until his medication kicked in. I am a single working mother, so I don't have time to sit at home with my child and do school work all day! I tried to suggest so many different options, but they were unwilling to work with my son's ADHD. Does your child go to a public or private school? I have just posted a thread about this, because with a private school, they can pretty much tell you to "take it" or leave. I'm interested to know how it turns out with your situation.

I think the teacher must understand what the child is going through, What you needed to do is to talk to the teacher to explain her /him the situation.

Start simple.

1 - Meet with the teacher and review your concerns. After the conference, send a "Conference Summary". This is a letter that reviews your concerns, teacher's response, agreements, etc.

2 - If this does not work, write the administrator a letter and include the original Conference Summary.

If your issues with the teacher are that bad, go straight to step 2.

Her recommendation is a gray area in terms of ethics and law, so I will not comment in that arena. Teachers can make educational recommendations, but they cannot have opinions on meds. Good luck on getting that specific issue enforced. I would just focus on the big picture.
