Noncompliance with 504 Accommodations

I have a 10th-grade dd with ADHD, ex function, slow processing, depression and anxiety and has a 504. Basically the accommodations were not followed and her grades are rather low (E's, D's, C's). I wrote a letter complaining of noncompliance to the principal, counselor and several people at the county headquarters. The only response was from the counselor who is setting up an annual review meeting with no mention of noncompliance. Is this normal for a 504? Is it OK to ignore the fact that it isn't being followed? Is this something you can discuss at these meetings? Would I be better off with an IEP? As you can see, I am totally confused! Thanks!!

Hello and Happy New Year:

I'm no expert on ADHD accommodations, but my understanding is that 504 Plans don't come with as many legal requirements as do IEPs. If you can secure an IEP, you're better off in the long run because the school is legally obligated to stick to it. Not that there's any excuse for your daughter's school dismissing her existing accommodations - it's disappointing, very frustrating, and just plain wrong.

As a starting point, I would suggest downloading ADDitude's free report about securing classroom accommodations for children with ADHD.

I would also recommend reading through these articles for advice on working with the school on an IEP...

The first step to IEP is to request the application in the offic

The testing done acts as a baseline and the evidenced abilities are the means by which the FAPE IDEA IEP is qualified. After you apply for the IEP the school has to respond in writing. There is a booklet or pamphlet which will further detail the info you need and many numbers you may contact. Call the superintendents office and/or the DOE special ed director for the proper office and address to formally complain that your child is not recieving an appropriate free education. Low grades in a regular ed classroom are not an appropriate rate of learning for her. If she is recieving support to show grasping the regular education lessons and achieving progress learning then you would not be conserned. Esencially you will desern how she does learn and then have a clear evidenced based tests by specialists who can specify where she needs supports and what those may include. The diagnostic information you know have is general. by testing her IQ proformances in specific areas you will both have a picture of where her learning stregths are and what and how any weakness is impacting her ability to show success in the regular ed class setting. Then the materials to devise an appropriate education plan are available. 504 basicily allows a diagnoses indivigual to compete with peers. this alows wheel chair access and other equiptment needed to be included as an accomidation IF it does not interfere with the learning of others.
