Trouble Getting a 504 for My ADHD Daughter

My daughter was first diagnosed with ADD, by a licensed psychologist, at the end of her 6th grade year, after struggling in her 6th grade year with organization and being easily distracted. When I approached her school counselor, she stated that I could not enroll her in a 504 unless it "substantially limited" her learning. She kept reinterating that. I finally came out an stated that basically she has to be failing to get help, and the counselor stated "we don't like to say it like that, but yes". That upset me greatly. I am very much proactive in everything I do, I want to be ahead of the game before problems start. She made A's and B's her first quarter, but that was with a lot of effort on my and two of her teachers parts. Luckily, she has great teachers this year, but I am concerned about future years. I am not sure where to start, or if I should wait to she how she does the rest of this year.

ADHD Accommodations

Hello Holly:

Welcome to the ADDitude forums and thank you for your post. The short answer is NO - your daughter does not have to be failing in order to qualify for a 504 plan. Federal law requires public school to provide educational accommodations for children with ADHD or other learning disabilities. And you are right to fight for these before serious trouble begins - prevention is key!

As a first step, I would recommend downloading a few of ADDitude's free Printables about ADHD accommodations: A Parent's Guide to ADHD School Accommodations, 9 Ways to Achieve Success at School, and Classroom Accommodations to Help ADHD Children.

These should give you the ammunition you need to get started. ADDitude's articles about your legal rights with ADHD could also help.
