Failing Student Does Not Qualify for Special Education Services

My son is 11 yrs old has repeated the 4th grade twice and nothing has changed. Has taken the TAKS test at least six times and not one time passed. The accommodations are not working and he is still struggling to work on his grade level. He is currently under Section 504, but that does not help him get better.I know I am missing something I just don't know what. We are starting a new school this school year I hope he gets better.

Accommodations Help

Hi:

I can understand your frustration and your hope for a better school year at a new school. I'm no expert, but I would suggest a new evaluation for your son before the school year begins. After the challenges he's faced in the last few years, it seems reasonable that you should make sure he doesn't qualify under IDEA for an IEP at his new school.

If not, then it's obviously just very important to communicate to his new teachers and administrators the accommodations he's been receiving so far and the problems that are impeding his learning - perhaps some new perspectives and experiences can help devise a plan that meets with better results...

The sooner you can schedule that meeting with your son's new school, the better. And here are some resources that can help you prepare:

Take it from a parent that was told this up to this past January, you qualify. The school and school district just don't want to help you because it will cost them $$$s. You need to push harder and show them you know the law. You need to recite the actual law code #'s (ie: § 300.304 is one of them). Google Wrightslaw. They have tons of stuff available and it is easy to understand. Even if you are not asking for costly help, schools tend to shy away from helping saying you only need a 504. This is because they 'can' work with a 504 when they want to, with an IEP, they, by law, HAVE to work with your child. You need to fight, true, but it can be done. If you know of anyone that can be an advocate (and I do not suggest the advocate that is working with the IEP team any more than necessary. Remember they are employed by the school district.) A teacher maybe that knows the 'other side' of it is always good. Good luck. Gotta go for now. Will try to check back soon. pj

Getting Advocate Help

I am having the same problems with my children getting assistance for them. There is a group called CAUSE they are located everywhere. I have a local number for my area 1-248-424-9610. They are advocates that will help you free of charge to get the help that your child needs. I'm sure they can direct you to a CAUSE office in your area.
